What's Required Before We Notarize a Document
Texas Notary Handbook states that signers be identified either by personal knowledge or by one or more of the following (unexpired) documents:
State-issued Driver's License
State-issued Identification Card
United States Military Identification Card
United States Passport
Alien Registration Card with Photograph
Personally known, which means the notary public has an established relationship with the individual (regular interaction over a period of time giving the notary a deep-seated belief that the person is who they say they are).
Before Your Notarization Checklist
Preferably Do NOT Sign - Do not sign any documents until in the presence of the notary. This eliminates the need for additional notary certificates to acknowledge signatures already on the document.
Do NOT Tear Apart Any Stapled Documents - Never disassemble any stapled document as it could nullify the authenticity of the package, thus forfeiting its eligibility to be notarized.
Fill In Blank Spaces - Completely fill in all blank spaces in documents before the notary arrives, but DO NOT SIGN.
Document Questions - If you have questions about the documents you are signing, you must contact the person who provided them to you. A notary public can NOT provide legal advice or assistance.
Every Signer Must Physically Appear & Have Government Issued ID - During the signing process, each signer must physically appear, have basic understanding of documents to be signed, and not be under duress to sign documents.
Know Which Notary Certificate You Need - It is imperative that the signer know which Notary Certificate (if applicable) is needed as the notary cannot legally advise which one to use.
Documents That We Cannot Notarize
Documents with names that do not match the name of the signer
Copied signatures (Faxed or photocopies are illegal to notarize)
Any publicly recordable document (for example):
Birth Certificates
Marriage Certificates
Death Certificates
Deeds
Documents with blanks
Signing Location Requirements
To ensure the notary process is efficient and seamless, a well-lit and ventilated workspace with a table large enough to accommodate your documents is preferred so that all parties can sign comfortably. The table should be cleared off to keep all documents organized as well as being smooth to ensure our stamp makes a clean imprint on each document.
Minimal distractions during this time are necessary to ensure the accuracy and efficiency of the process.
It is the upmost importance that our notaries are safe and comfortable at all times while performing their duties. If at any time, the environment or atmosphere changes for them, the notary is required to immediately remove themselves from the area until it is deemed safe or another workplace is available. This may cause the work to be cancelled for reasons outside of our control.
